Robert Weisenburger

Robert E. Weisenburger is a civil litigator who has successfully represented clients in numerous civil actions from inception through resolution, including at trial.  Prior to joining LiMandri and Jonna in 2021, Mr. Weisenburger worked for White and Bright LLP focusing primarily on commercial and real estate litigation, including handling complex commercial fraud and contract disputes.  Mr. Weisenburger also has experience in a broad range of other practice areas, including personal injury, medical malpractice, construction defect, and insurance bad faith litigation, among others.  Mr. Weisenburger is expanding his practice at LiMandri and Jonna LLP to include Constitutional litigation.

During law school, Mr. Weisenburger had the honor of clerking as extern for the honorable William V. Gallo, Magistrate Judge for United States District Court for the Southern District of California, and the honorable Margaret M. Mann, Chief Judge for the United States Bankruptcy Court for the Southern District of California.  He also worked as a law clerk practicing in the areas of insurance defense, intellectual property, and federal appeals.

Representative Business and Real Estate Litigation Experience

  • Successfully co-defended real estate broker from $2 million dollar damages claim against broker for alleged conspiracy to commit forgery of a seller’s signature on a commercial real property purchase and sale agreement.  Mr. Weisenburger assisted in successfully establishing at trial that the broker did not conspire in the forgery and that the broker was liable for only $50,000 rather than $2 million dollars.
  • Obtained favorable settlement for a real property development contractor in the form of a $7 million dollar deed of trust.  The matter concerned a contract dispute over development fees for an $85 million residential housing project located on 465 acres in Riverside County.  Settlement occurred approximately 2 months before trial, shortly after Mr. Weisenburger defeated a summary judgment motion brought by the defendant owner of the development project.
  • Obtained favorable settlement in the amount of $590,000 for purchaser of FedEx trucklines in a $1.4 Million asset purchase transaction due to non-disclosure of material facts by the seller.  The case is ongoing against additional defendants who conspired in the fraud.
  • Obtained highly favorable settlement result on behalf of landlord in a commercial lease dispute concerning real property valued in excess of $1.8 million dollars located in Carlsbad, California.  The case settled favorably at mediation within two weeks of Mr. Weisenburger taking the deposition of the tenant.
